The Same-Day Change Rule

What do I do if customer refuses to pay for agreed upon changes?

Don't argue about the change later. Document the change now.

97% of US specialty trade contractors surveyed say they begin work on at least some change orders before those change orders are approved

Somebody asks for extra work on site. You've got about sixty seconds to turn that into something you can prove. The Same-Day Change Confirmation Pack is the form, the script, the price build-up and the twenty-two ready-to-send messages that make it take five minutes — before the crew starts.

This is how the dispute starts

Nobody disputes that the work happened. They dispute what it was, what it cost, and who said yes.

Read the sentences contractors actually hear at final account and you'll notice something. Not one of them argues that the extra work wasn't performed:

  • “We never approved that price.”
  • “We thought that was included.”
  • “The owner didn't authorize it.”
  • “The GC told you to do it, not us.”
  • “We never received a change order.”
  • “That text was only discussing the work.”

Every one of them is an argument about a record that doesn't exist. And by the time you're having it, your leverage is gone — the work is built, the material is installed, and all you've got left is a conversation about what somebody meant four months ago.

You are not going to win that argument. You're going to make it unnecessary — with a five-minute record created on the day.

The 97% figure above is from the survey named beside it. Every dollar amount in this product is an illustrative example built to demonstrate a method, not a benchmark and not a promise of any outcome.

If any of these are your questions, this is your product

“Someone asked for extra work — what do I say in the next sixty seconds?”
“How do I put a price on this while they're standing right here?”
“What exactly do I write so it isn't ambiguous later?”
“The GC told me verbally. Now what?”
“They won't sign anything. Do I just do it?”
“How do I say no without wrecking the relationship?”
“It's an emergency — do I stop and write it up?”
“Is my markup actually giving me the margin I think it is?”

Every one of these is answered with a form, a script, a message you can copy, or a calculation. Not with general advice.

Meet the Same-Day Change Confirmation Pack

Four things have to happen before the crew starts

Most advice stops at “get it in writing.” That doesn't help if you can't describe the scope tightly, can't price it on the spot, don't know who's allowed to approve it, and can't ask for confirmation without sounding like you don't trust anyone.

1. Capture

A ten-question script for the sixty seconds after somebody asks, in seven versions — homeowner, GC, superintendent, property manager, architect, tenant rep and site manager. It opens with “sure, we can do that,” which is why nobody objects to the questions that follow.

2. Price

A build-up card you can work through in ninety seconds: burdened labour, materials, equipment, subs, other direct costs, then your markup. Plus the arithmetic almost everyone gets wrong — markup is not margin, and the gap is bigger than it looks.

3. Confirm

Twelve SMS templates and ten emails covering every scenario from a routine add to an emergency to a client who won't sign anything. Plus the one-page form, printable and editable, for anything bigger than a text message.

4. File

A change-numbering system, a project folder structure, a photo and evidence guide, and a change log spreadsheet whose dashboard shows you the one number most contractors have never seen: approved work that's complete and still not invoiced.

The Workflow

Nine steps. Under five minutes. Same day, every time.

Steps 6 and 7 are the two that get skipped — and they're the two that decide whether you get paid without an argument.

1Capture the request
2Define the change
3Price it
4State exclusions
5Identify the approver
6Confirm in writing
7Wait for confirmation
8Perform the work
9Save the evidence

The Same-Day Change Rule: scope, price, exclusions and authorisation, written down on the day — and before the work starts wherever that's practical.

What's Included

Nine files. One system.

Everything opens and works the same day you buy it. No software to install, no subscription, no account to create.

01 — The Same-Day Change Confirmation Guide (PDF, 89 pages)Twenty chapters and six appendices: why verbal approvals turn into disputes, the five stages people confuse, the four clarities, who can actually authorise work, emergencies, refusals and hidden conditions, the ten-scenario decision tree, six worked before-and-after examples, the evidence chain, six digital workflows, change numbering, the daily log, and a 30-day implementation plan. Includes 7 charts and diagrams.
02 — Same-Day Change Confirmation Form (PDF, printable)The one-page field form: project information, the request in the requester's words, added / removed / changed scope, a full price build-up, schedule impact, an assumptions-and-exclusions block, and an authorisation panel with the method of confirmation recorded. Print a pad and keep it on the clipboard.
03 — The Same Form, Editable (DOCX)The identical form in Word, so you can add your logo, licence number and your own terms, and hand it to a client with your company name on it.
04 — SMS & Email Script Library (DOCX + TXT)All 22 messages, ready to copy: 12 SMS templates (routine request, verbal instruction, waiting on approval, vague “go ahead,” GC instruction, price to follow, emergency, second change, refusal to confirm, end-of-day recap, closeout, wrong approver) and 10 emails. The plain-text version copies cleanly on a phone.
05 — Pricing-on-the-Spot Markup Card (PDF, printable)The build-up, the six words people use interchangeably and shouldn't (cost, markup, margin, overhead, profit, contingency), both conversion formulas, and a quick calculator at 10 / 15 / 20 / 25 / 30% with a blank row for your own number. No universal markup is prescribed — you fill in yours.
06 — Same-Day Documentation Checklist (PDF, printable)The 17-point full checklist for the end of the day, and the 30-second five-question version for the moment somebody's standing in front of you. Plus the end-of-day sweep that catches everything you didn't write down.
07 — Quick-Reference Field Card (PDF, printable)“Before You Do Extra Work” — eight questions on one page, with blanks for your burdened labour rate, your standard markup, your form threshold, your current job's approver, and your contract's notice period. Truck, toolbox, estimating folder.
08 — The Change Log (XLSX)Fifteen columns with dropdown validation and conditional colour, a dashboard with twelve calculated metrics, a lists sheet and a 15-minute weekly review. The dashboard's headline figure is “complete but not invoiced” — approved work you've already built and never billed.
Bonus — the scripts, worksheets and decision treeThe Verbal-Instruction Capture Script in 7 audience versions, 8 refusal scripts covering the objections you actually hear, a ten-scenario “what if?” decision tree, six worked before-and-after examples across six trades, five printable worksheets, a 19-term field glossary and a 12-question FAQ.
Who This Is For

Built for whoever is standing there when someone says “can you just…”

Business owner, estimator, project manager, foreman or field worker — anyone with authority to talk about price and document extra work.

Who this is not for

If you need a legally binding change order drafted for your jurisdiction, a contract review, or advice on lien rights and payment claims, this isn't that — you need a construction attorney. If you're on large public works with a prescribed change and directive procedure, follow that procedure; this pack can only support it, not replace it.

Your written contract always controls. Where a contract or a project procedure prescribes a different change process, follow that one, and have your documents reviewed by a qualified construction attorney where you work.

Before / After

From “sure, we'll do it” to “sure — let me confirm the scope and price first”

Before

  • “Sure, we'll do it.” Then the work happens.
  • The price gets discussed out loud and never written down
  • Nobody knows who was allowed to approve it
  • Nothing states what the price excludes
  • Extras live in text threads, memory and a foreman's notebook
  • At final account you're scrolling texts trying to prove what was agreed
  • Small changes never get written because writing them feels petty
  • Work you finished months ago is still sitting uninvoiced

After

  • “Sure. Let me confirm the scope and price first.”
  • Every number you say out loud is repeated in writing the same day
  • The approver is agreed at kickoff, in writing, before there's a change
  • Every confirmation carries an exclusions clause
  • Every change has a number, a folder, photos and an approval on file
  • The record reads in order and a stranger can follow it
  • A four-minute message makes small changes worth writing
  • The log's dashboard tells you what's complete and still not billed

FAQ

Questions before you buy

Can't I just use a text?

Yes — and for small changes a text is exactly what this pack tells you to use. The point isn't the medium, it's the content. A text containing the scope, the price, the exclusions and a request for a specific reply is a confirmation. A text saying “ok will do” under a vague sentence is a discussion, and “that text was only discussing the work” is one of the most common things a contractor hears at final account. You get twelve of the first kind, ready to send.

What if the customer says yes verbally?

Take the yes, then confirm it the same day: “Just confirming your instruction today at 14:10 to…” You're not asking them to approve it again — you're recording what they already said. Most people read it, see it matches, and say nothing, which is useful in itself. If it doesn't match what they meant, far better to find that out today than in month four.

What if the GC tells me to do it?

Confirm the instruction upward in writing the same day, price it on whatever form the subcontract requires, and be explicit about what you're proceeding on. The pack gives you the SMS, the email and the sequence. Whether a verbal GC instruction creates a payable obligation depends on your subcontract and your jurisdiction — that's a question for a construction attorney, and this product doesn't pretend to answer it.

What if I don't know the final price yet?

There's a template for exactly that. It confirms you received the request and gives a date for the price, while stating clearly that the work has not started. What you must not do is perform the work on the promise of a price later — that removes the client's ability to decline and removes your ability to be paid what it was worth.

What if the customer refuses to sign?

A signature is one method of confirmation, not the only one. The pack ranks them: signature, email reply, one-word text, approval inside a project-management system. Most people who won't sign a form will happily reply “approved” to a text. If every method is refused, you pause the change — not the job — with a message that stays warm and leaves the door open.

What if it's an emergency?

Do the minimum necessary to make it safe or stop the damage, photograph first where it's safe to, notify immediately by phone and then in writing the same hour, and stop at the boundary of the emergency. The remaining work goes back through the normal process. Check what your contract says about emergency work before you need it — some contracts and some public-works rules impose their own notice requirements.

Does this replace a formal change order?

No. This is a same-day confirmation system that sits before and alongside whatever formal change order your contract requires. If your contract prescribes a form, a signatory or a system, use it — and use this pack for the parts the contract doesn't give you: the capture conversation, the pricing build-up, the exclusions language, the scripts and the tracking.

Will this guarantee that I get paid?

No, and any product that tells you otherwise isn't being straight with you. Whether a change is payable depends on your contract and on the law where the project sits. What a clear, contemporaneous record does is remove the ambiguity that most disputes actually turn on: what was asked for, what it cost, and who said yes. That's a real advantage, and it's the only one this pack claims.

Is this legal advice?

No. This is an operational documentation tool providing educational and organisational guidance only. It isn't legal advice, the forms aren't attorney-drafted contract instruments for your jurisdiction, and no attorney-client relationship is created by buying it. Your written contract controls. Have your contract and your change procedure reviewed by a qualified construction attorney before you rely on them.

I'm a one-person operation. Is this overkill?

It's arguably more important, because there's nobody to catch what you miss. Setup is about ten minutes, and the cost per change is one text message. The daily log matters just as much with two jobs as with twenty.

Does it work outside the United States?

The method, the form, the scripts and the pricing build-up are jurisdiction-neutral. The legal layer is not: notice periods, the effect of a signature, statutory payment and adjudication procedures and public-works change rules all differ. Where the pack touches those, it tells you to check what applies to you rather than asserting a rule.
